Part I: In these Terms and Conditions, the following definitions shall apply:

Premium Automobiles	Premium Automobiles Pte Ltd
User	A person who has successfully registered for an account or made a purchase as a guest at audiflagshipstore.sg.
Website	The Website at the address "audiflagshipstore.sg".
Terms	These terms and conditions.

2) Application

2.1 Part II of these Terms shall govern your obligations with regards to your use of this Website in general as well as all accounts you may set up on this Website. By using this Website, you accept, without limitation or qualification, the Terms in Part II and any additional terms set forth in any related website.

2.2 Part III governs account creation, participation and purchasing from audiflagshipstore.sg. By registering for an account and purchasing from audiflagshipstore.sg, you accept without limitation or qualification the terms in part III and any additional terms communicated to you as a User. You are responsible for keeping themselves informed of the current Terms of the Audi Flagship Store. Premium Automobiles reserves the right to change any of these Terms at any point in time. Changes to the Terms will be posted here with immediate effect, so please check this page often. If you do not agree to the terms contained herein, please do not use this Website.

Part II: Terms and Conditions of use of Website

3) User submissions

3.1 All User submissions will become Premium Automobiles' sole and exclusive property and shall not be returned to you. You shall not use a false email address or mobile number, pretend to be someone other than yourself, or mislead Premium Automobiles or third parties. Premium Automobiles may, on request of a User, remove or edit any submissions.

3.2 When you are a User on the Website, you may receive (such as newsletters, confirmation emails, information on offers, offers from Premium Automobiles related companies and Audi Singapore). You can unsubscribe from such information emails at any time by sending an email to [the Data Protection Officer] to unsubscribe.

4) User obligations

4.1 You warrant that all information provided during account registration is true, complete and accurate and that, in the event of any change in your particulars provided to Premium Automobiles, to the Data Protection Officer.

4.2 Without limitation, you undertake not to use the Website and/or any information obtained from the use of the Website for any fraudulent purpose or any purpose other than what Premium Automobiles has intended them to be used.

5) Copyright and trademarks

5.1 All content, pictures and other works published on the Website are subject to the copyright of Audi Singapore and its affiliates, including but not limited to Audi AG, Ingolstadt, Premium Automobiles, if not otherwise indicated. Any duplication, distribution, storage, communication, broadcast and reproduction or transmission of the contents without Audi Singapore’s written approval is prohibited. TFSI, quattro, as well as the model names are registered trademarks of Audi AG.

6) Indemnity

6.1 You agree to indemnify, defend and hold Premium Automobiles, all Premium Automobiles subsidiaries, affiliates, subcontractors, agents, directors, employees, officers, information providers, advertisers or partners, licensors and licensees, (collectively “Indemnified Parties”) harmless from and against any and all liability and costs (including, without limitation suits, litigation costs, attorneys’ fees, of any kind and nature), incurred by the Indemnified Parties in connection with any claim arising out of your access to and/or use of the Website or any breach by you of these Terms of the foregoing representations, warranties and covenants or any other actions connected with the use of the Website. You will cooperate as fully as reasonably required on Premium Automobiles’ defence of any such claim. Premium Automobiles reserves the right at Premium Automobiles’ own expense to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any matter without Premium Automobiles’ written consent.

7) General provisions

7.1 Premium Automobiles administers the Website from the Premium Automobiles’ office in Singapore. All content on the Website has been prepared in accordance with the laws of Singapore and may not satisfy the laws of any other country. Premium Automobiles makes no representation that the Website is appropriate or available for use outside Singapore, and access to the Website from territories where its contents are illegal or restricted is prohibited. If you choose to access the Website from outside Singapore, you do so, on your own initiative and are responsible for compliance with applicable laws.

Part III: Terms and Conditions of creating an account and purchasing from the Website

8)  Website

8.1 Participant is aware of the Terms as well as in Premium Automobiles’ Privacy Policy, particularly with regards to the collection of personal data.

9) Payment

9.1 In order to make a purchase on the Website, Users will need to create an account or check out as a guest. Premium Automobiles will not be liable, and you are independently responsible for complying with all applicable laws related to your use of our payment gateway's services.

9.2 All prices stated on the Website includes GST unless otherwise stated. 

10) Refund policy

10.1 Purchases made on the Website will not be refundable.

10.2 Premium Automobiles reserves the right to reject any requests for refund that do not fulfil our Terms or for any other reason whatsoever.

 

11) Exchange policy

11.1 Exchanges made on the Website are allowed, provided the following terms are fulfilled:
a. Within 7 days from receiving the purchase

11.2 Premium Automobiles reserves the right to reject any requests for exchanges that do not fulfil our Terms or for any other reason whatsoever.

 

12) Promotions

12.1 At the Audi Flagship Store, only 1 discount code can be utilised during a purchase. Discount codes cannot be combined or used in conjunction with other discounts.

12.2 "AFS10" is a discount code that entitles you a 10% off at the Audi Flagship Store, excluding service packages, products that require installation, or discount products. 

12.3 Discount codes are not applicable on the purchase of products that require installation, or products that are already discounted.

 

 

13) New Car Delivery Installation

13.1 This fulfilment option is only applicable for Users who have just purchased a new Audi vehicle, have yet to collect it, and wish to have their Audi Flagship Store purchase(s) prepared and fulfilled with their new car delivery.

13.2 Audi Flagship Store purchases must be ordered at least 10 working days before the new car delivery date.

13.3 Premium Automobiles will not be liable for any delays on the User's new car delivery, as a result of non-fulfilment of clause 13.2.

 

 

14) Premium Automobiles’ rights and limitation of Premium Automobiles’ liability

14.1 Premium Automobiles shall not be liable for, nor be bound by, any statements representations made or actions taken, of any third party, including any party which Premium Automobiles may have engaged to assist Premium Automobiles in the administration of the Sale and/or any telephone helpline, email associated therewith.

14.2 Premium Automobiles reserves the right, in its absolute discretion to withdraw or terminate the Sale without liability or change any of the applicable Terms without prior notice.

15) Personal data

15.1 In order to fulfill the orders, Premium Automobiles needs to keep personal data, including but not limited to name, email address and contact number of each User. Some of this data may be shared with suppliers and other parties providing support for the order. When a user registers, personal data may also be collected and stored. Our Privacy Policy shall govern our obligations in this regard.

16) Governing law

16.1 The Website is governed by the laws of the Republic of Singapore. Any dispute arising out of or in connection with the Website shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of Singapore International Arbitration Centre (“SIAC”) for the time being in force which rules are deemed to be incorporated by reference to this clause. The decision of such Tribunal shall be final and binding upon the parties.
